Customer Terms & Conditions

‍Welcome to JuBE Art.

‍These Terms & Conditions ("Terms") apply when you access the JuBE Art website or purchase artwork or other products through the JuBE Art marketplace.

‍By using our website or placing an order, you agree to these Terms.

1. About JuBE Art

JuBE Art is an online marketplace showcasing original artwork, handmade pieces and creative works from independent artists and makers.

‍JuBE Art provides the online platform through which customers can discover and purchase works offered by participating artists.

Unless otherwise stated, the artwork listed on JuBE Art is created, owned and supplied by independent artists.

JuBE Art does not claim ownership of artwork created by participating artists.

2. Using the JuBE Art Website

You may browse the JuBE Art website and purchase available artwork for personal use.

When using our website, you agree that you will not: ‍

• use the website for any unlawful or fraudulent purpose;
• interfere with the operation or security of the website;
• attempt to gain unauthorised access to any part of the website;
• copy or reproduce artwork images without permission;
• provide false or misleading information; or
• use the website in a way that may cause damage to JuBE Art, an Artist or another person.

We may restrict or suspend access to the website where we reasonably believe these Terms have been breached.

3. Artwork and Product Information ‍

We aim to ensure that all artwork listings are as accurate as possible.

Each listing may include information such as Artist name, Artwork title, Medium and materials, Dimensions, Description, Framing information, Price, and Shipping or delivery information. ‍

Because many JuBE Art pieces are handmade or original, slight variations and imperfections may form part of the character of the work. ‍

Please carefully review the photographs, dimensions and description before purchasing.

4. Artwork Images and Colour

We make reasonable efforts to display artwork accurately

However, colours may appear differently depending on your computer, phone or tablet; screen brightness; monitor settings; lighting conditions; and photography.

Some listing images may have been cropped, resized, had their background removed or had minor lighting adjustments made for presentation purposes. These adjustments are not intended to alter the appearance or artistic content of the artwork itself.

If colour, size or another characteristic is particularly important to you, please contact JuBE Art before purchasing.

5. One-of-a-Kind Artwork and Availability ‍

Many pieces available through JuBE Art are original and one-of-a-kind. An artwork may therefore only be available in a quantity of one.

Artists may also display or offer their artwork through other galleries, exhibitions, markets or sales channels.

While we ask Artists to keep their JuBE Art listings current, occasionally an artwork may sell elsewhere before the JuBE Art listing has been removed.

If you purchase an artwork that is unexpectedly no longer available, we will contact you as soon as possible and provide a full refund of any amount paid for that artwork.

6. Prices

Unless otherwise stated, all prices displayed on JuBE Art are in Australian Dollars (AUD).

The price shown on the product page will indicate whether shipping is included or charged separately.

Where an artwork is advertised with free shipping, the shipping and packaging cost may already be incorporated into the listed price.

7. Orders ‍

Placing an order through the JuBE Art website constitutes an offer to purchase the selected item.

An order is not considered final until payment has been successfully processed and the order has been accepted and confirmed.

We reserve the right to cancel or decline an order where reasonably necessary, including where an artwork is no longer available; incorrect pricing has been displayed; payment cannot be processed; we reasonably suspect fraudulent activity; or there has been an obvious website or listing error.

If we cancel an order after payment has been received, the amount paid for the cancelled item will be refunded.

8. Payment

Payment must be made using one of the payment methods offered at checkout.. ‍

Payments may be processed by third-party payment providers.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

JuBE Art does not generally store complete credit or debit card details.

9. Shipping and Delivery

Artwork is generally packaged and dispatched directly by the Artist unless otherwise stated.

Shipping methods, costs and estimated delivery information will be displayed on the artwork listing or provided during the purchase process where applicable.

Customers are responsible for providing accurate delivery information, including name, street address, suburb, state, postcode, phone number and email address.

10. Delivery Delays

Delivery times are estimates only.

JuBE Art and participating Artists cannot guarantee delivery on a particular date where delays occur due to circumstances outside their reasonable control, including postal or courier delays, severe weather, industrial action or other transport disruptions.

We will provide reasonable assistance where an order appears to be significantly delayed or lost.

11. Returns and Refunds

Because many JuBE Art products are original, handmade or one-of-a-kind, we generally do not offer refunds for change of mind.

However, nothing in these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law.

You may have rights to a replacement, refund or other remedy where goods are faulty; arrive damaged; are not of acceptable quality; are significantly different from their description; are not the item ordered; or otherwise fail to meet an applicable consumer guarantee.

12. Damaged Artwork

If your artwork arrives damaged, please contact JuBE Art as soon as possible at hello@Jube-art.com.au.

Where possible, please include your order number, photographs of the external packaging, shipping label, internal packaging and photographs clearly showing the damage to the artwork.

Please retain all original packaging until we have reviewed your claim.

Where possible, delivery damage should be reported within seven (7) days. This requested timeframe does not limit any rights you may have under Australian Consumer Law.

13. Cancellations

If you wish to cancel an order, please contact JuBE Art as soon as possible.

We will try to assist where the artwork has not yet been dispatched.

Once an artwork has been packaged or dispatched, cancellation may not be possible unless required by Australian Consumer Law or otherwise agreed by JuBE Art and the Artist.

14. Intellectual Property

Artists retain copyright and intellectual property rights in their artwork.

Artwork images displayed on JuBE Art are provided for viewing and purchasing purposes.

Unless you have permission from the relevant rights holder, you must not copy, reproduce, distribute, publish, modify, commercially exploit or create products using artwork or artwork images displayed on the JuBE Art website.

Purchasing an original artwork does not automatically transfer copyright or reproduction rights to the purchaser.

15. Artist Information

Artist biographies, descriptions and other Artist information displayed on JuBE Art may be supplied by the Artist.

JuBE Art may edit this information for spelling, formatting, clarity or website presentation.

We take reasonable steps to maintain accurate information but cannot guarantee that all Artist-supplied information will be free from error.

16. Independent Artists

Artists participating in JuBE Art operate independently.

Nothing in these Terms creates an employment relationship, partnership or joint venture between JuBE Art and an Artist.

JuBE Art provides the marketplace, payment and promotional infrastructure through which Artists can offer their work to customers.

17. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where a provision of these Terms is inconsistent with a right that cannot legally be excluded, that statutory right will apply.

18. Limitation of Liability

To the maximum extent permitted by law, JuBE Art is not responsible for indirect or consequential loss arising from use of the website or purchase of artwork.

Nothing in this section excludes liability that cannot lawfully be excluded or restricted, including liability arising under Australian Consumer Law.

19. Website Availability

We aim to keep the JuBE Art website available and operating correctly.

However, we cannot guarantee uninterrupted access. The website may occasionally be unavailable because of maintenance, technical problems, website updates, payment provider outages or circumstances outside our reasonable control.

We may update, modify or discontinue website features from time to time.

20. Privacy

We collect and handle personal information in accordance with our Privacy Policy.

By using the JuBE Art website, you acknowledge that personal information may be collected where necessary to process your order, arrange payment, arrange delivery, communicate with you, provide customer service and operate the JuBE Art marketplace.

21. Marketing Communications

Where you choose to subscribe to JuBE Art marketing communications, we may send you information about new Artists, new artwork, exhibitions, local events, promotions, JuBE Art news and other relevant updates.

You may unsubscribe from marketing communications at any time using the unsubscribe option provided or by contacting us.

Transactional emails relating to your orders may still be sent where necessary.

22. External Links

The JuBE Art website may contain links to third-party websites, including Artist websites, social media profiles, payment providers and delivery services.

JuBE Art is not responsible for the content, privacy practices or operation of external websites.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, website, policies or legal requirements.

The current version will be published on the JuBE Art website together with its effective date.

Changes will not remove rights that a customer already has in relation to a completed purchase where those rights cannot lawfully be excluded.

24. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You and JuBE Art submit to the jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.

Nothing in this section limits any rights a consumer may have under applicable Australian law.
